I don't know what it is, but i wanted to say that it's a very nice shot and a great pose by the bird in question.

Pa I think that you have got it. The dark mark under the eye is the clincher. Thanks a lot.

It is a fantastic photograph, but it my opinion it isn't from an angle that will make a positive ID easy. I'm leaning towards brown falcon, Falco berigora, because of the dark thighs, but it could easily be a gray falcon, F. hypoleucos, or an Australian kestrel, F. cenchroides. All three species have dark under the eyes.
Bugger you ATJ, just when I thought we had it

oneputt, I am working on computers so was going to have a look when I got the birdy books available
but luckily dont think I need em here. looks like a Nankeen Kestral, also known as australian kestral. although the ones around here look darker than this will confirm when I check if any falcons look similar when I have access to my raptor book check out my image gallery @

I'm not so sure that it's a Nankeen Kestral... They are VERY close in my book so it's hard to tell but I think it may be a Brown Falcon (light morph).
My reason being that the Nankeen Kestral has yellow legs and eye-rings whereas the Brown falcon has grey ones (as in this picture). Other than that, the light morph Brown Falcon looks very similar in markings to the Male (I think) Nankeen Kestral (including the brown stripes). I think a different angle could help. I could be totally off the mark here but that's just my two cents. Paul. http://www.australiandigitalphotography.com
Living in poverty due to my addiction to NIKON... Is there a clinic that can help me?
agree with this comment wholeheartedly. the light morph of a brown falcon looks like a kestral but has the dark bit on the thighs so that may be the answer Steve check out my image gallery @
